We inform you that in the Official Journal no. 902 of 16.11.2017 was published Government Emergency Ordinance no. 82/2017 for amending and supplementing certain legislative acts (“OUG – Government Emergency Ordinance – 82/2017”).
GEO 82/1997 introduces, among others, derogatory provisions from the social dialogye Law no. 62/2011, in the context of recent legislative amendments in the tax matters (in force from 1 January 2018) regarding the “movement” of social contributions from the employer to the employee.
Practically, GEO 82/2017 stipulates that for the implementation of the provisions regarding the amendment of regulations regarding the social contributions (required through GEO 79/2017), in the period 20 November – 20 December 2017 it is compulsory that the employers should conduct negotiations with their own employees, irrespective if there are collective labour agreements or not.
